Terms of Service

Important — Not a medical device or diagnostic service
Gene-Cortex.com is a clinical decision support tool. It is not a medical device, does not provide medical diagnoses, and must not be used as the sole or primary basis for any clinical decision, patient management, or genetic counselling. All outputs must be independently verified by a suitably qualified professional before any clinical action is taken.
1. Parties and acceptance
These Terms of Service (“Terms”) govern your access to and use of the Gene-Cortex.com platform, including the web application at app.gene-cortex.com and any associated APIs or services (collectively the “Service”), operated by Gene-Cortex.com Ltd, a company registered in England and Wales (“Gene-Cortex.com”, “we”, “us”, or “our”).
By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
The Service is intended exclusively for:
- Qualified healthcare professionals (including clinical geneticists, genetic counsellors, pathologists, and clinical scientists) acting in a professional capacity;
- Academic researchers conducting peer-reviewed or institutional research in genomics or clinical genetics; and
- Developers and organisations integrating the Service into their own platforms.
You must be at least 18 years old and legally capable of entering into a binding contract. By registering you represent and warrant that you meet these requirements. The Service is not intended for, and must not be accessed by, patients or members of the general public seeking personal health information.
3. Description of service
Gene-Cortex.com provides AI-powered copy number variant (CNV) interpretation. The Service aggregates publicly available genomic evidence and applies large language model (LLM) reasoning to generate structured interpretations intended to support — not replace — expert clinical review.
The Service is provided on an “as is” and “as available” basis. We do not guarantee continuous, uninterrupted, or error-free access. Features may be added, modified, or removed at our sole discretion.
AI-generated outputs reflect the model's probabilistic reasoning over training data. They may be incomplete, outdated, or incorrect. No output constitutes a clinical report, diagnostic result, or professional opinion.
4. Data and de-identification
You must not upload personally identifiable information (PII) or patient-identifiable data to the Service. All genomic coordinates, variant data, and associated information you submit must be fully de-identified in accordance with applicable law before submission — including, but not limited to, UK GDPR Article 4(1), the NHS Data Security and Protection Toolkit, and equivalent national regulations where applicable.
You are solely responsible for ensuring the lawfulness of any data you submit, including obtaining all necessary consents, approvals, and ethical clearances required under your jurisdiction.
Gene-Cortex.com processes submitted genomic coordinates solely for the purpose of providing the Service and improving its accuracy where you have consented to such use. We do not sell, share for advertising, or use your data to train models without explicit per-user, per-dataset consent.
5. Subscription and credits
Certain features of the Service require the purchase of analysis credits. Credits are consumed at the rates described on our pricing page at the time of purchase.
Credits are non-refundable once consumed. If an analysis fails due to a confirmed fault on our side, we will restore the consumed credit promptly. Stripe, our payment processor, applies its own refund policies to payments.
Subscription plans renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings page. Cancellation takes effect at the end of the current billing period; no partial-period refunds are provided.
6. AI limitations and absence of warranty
The AI models powering Gene-Cortex.com are general-purpose large language models that have been prompted and evaluated for genomic interpretation tasks. They are not trained on your local patient cohort, do not have access to real-time literature, and may produce outputs that are factually incorrect, inconsistent, or incomplete.
To the maximum extent permitted by applicable law, Gene-Cortex.com makes no warranty, express or implied, including no warranty of merchantability, fitness for a particular purpose, or non-infringement, regarding the accuracy, reliability, or clinical utility of any AI-generated output.
You agree that you will apply independent professional judgment to all AI outputs and that you will not rely on any output without appropriate clinical verification.
7. Prohibited conduct
You must not use the Service to:
- Upload patient-identifiable or re-identifiable genomic data;
- Provide genetic testing, diagnostic reporting, or clinical advice directly to patients;
- Reverse engineer, decompile, or extract the underlying AI models or evidence databases;
- Circumvent rate limits, authentication, or access controls;
- Use the Service in violation of any applicable law, regulation, or professional ethical code;
- Resell, sublicense, or create competing products based on the Service without our prior written consent.
Breach of this section may result in immediate account suspension and, where appropriate, legal action.
8. Intellectual property
All software, algorithms, evidence databases, UI designs, documentation, and other content comprising the Service are owned by Gene-Cortex.com Ltd or its licensors and are protected by UK and international intellectual property law.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for the purposes described herein. No other rights are granted. You retain ownership of any genomic data you submit, subject to the data processing terms in our Privacy Policy.
9. Privacy and data protection
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. Please read it carefully. By using the Service you acknowledge that you have read and understood the Privacy Policy.
Where you are a data controller in relation to end-patient data, and you are sharing data with us for processing, you should contact us to agree a Data Processing Agreement (DPA) before doing so.
10. Limitation of liability
To the maximum extent permitted by applicable law, Gene-Cortex.com and its directors, employees, agents, and licensors shall not be liable for:
- Any clinical outcome, patient harm, or misdiagnosis arising from use of the Service;
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of data, profits, goodwill, or business opportunities arising out of or in connection with your use of the Service.
Our aggregate liability for any claim under these Terms shall not exceed the total fees paid by you to Gene-Cortex.com in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by English law.
11. Termination
You may close your account at any time via your account settings page. We may suspend or terminate your access immediately, with or without notice, if we determine that you have violated these Terms, posed a risk to other users, or that continued access is unlawful.
Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including sections 6, 8, 10, 12) will remain in effect.
12. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of laws principles.
Any dispute that cannot be resolved by good-faith negotiation between the parties shall be submitted to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another jurisdiction, mandatory consumer protection rights under your local law are unaffected.
13. Changes to these terms
We may update these Terms from time to time. When we make material changes we will notify you by email or by a prominent in-app notice at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
We recommend checking this page periodically. The effective date at the top of this document indicates when it was last revised.
